Interwencje przedsiębiorców i organizacji branżowych przyniosły skutek. Rząd podjął decyzję o wycofaniu się z koncepcji wspólnego opodatkowania sklepów działających pod jedną marką franczyzową. Opodatkowane zostaną natomiast sieci sklepów należące do jednego właściciela. Wciąż trwa dyskusja o opodatkowaniu specjalnym handlu w weekendy i opodatkowaniu handlu paliwami. Nie wiadomo, czy rząd ustąpi w sprawie opodatkowania handlu w internecie. Ale na pewno zrezygnuje ze stawki progresywnej podatku na rzecz jednej, płaskiej – w tej sprawie interweniowała Komisja Europejska.
O swoich nadziejach na zmianę projektu mówili przedstawiciele Polskiej Izby Handlu, którzy spotkali się z ministrem finansów, Pawłem Szałamachą. Według ich relacji minister wysłuchał ich opinii z uwagą i zapowiedział rewizję projektu. Od kilku dni szef resortu był krytykowany za projekt podatku. Wątpliwości w tej sprawie zgłaszali nawet inni członkowie rządu i posłowie PiS.
– Mając na uwadze, że zaobserwowane procesy konsolidacyjne w polskim handlu mają korzystny wpływ na sytuację małych niezależnych placówek handlowych, należy rozważyć, czy nałożenie podatku w zaproponowanej formie nie spowoduje zatrzymania tego trendu. Istnieje obawa, że przedsiębiorcy, którzy są niezależnymi podmiotami, będą rezygnować z działania pod wspólną marką wyłącznie po to, aby uniknąć płacenia podatku. Istnieje ryzyko, że proces ten (ewentualna zmniejszona opłacalność tego typu współpracy) będzie mógł mieć niekorzystny wpływ na konkurencyjność na rynku oraz na kondycję polskich przedsiębiorców współpracujących dotychczas pod wspólną marką. Problem ten powinien znaleźć odzwierciedlenie w analizach wykonywanych w ramach oceny skutków regulacji – napisał w swojej opinii Mateusz Morawiecki, minister rozwoju.
Po środowym (10.01) spotkaniu konsultacyjnym między rządem a handlowcami szef Parlamentarnego Zespołu na rzecz Wspierania Przedsiębiorczości i Patriotyzmu Ekonomicznego Adam Abramowicz (PiS) stwierdził, że podczas dyskusji ustalono, że w projekcie zmienione zostaną również przepisy dot. franczyzy. "Definicją franczyzy będzie w ustawie znak towarowy w powiązaniu z przepływami kapitałowymi albo przepływem towarów. Była na ten temat dyskusja na sali. Niektórzy mówili, że lepsze jest pierwsze rozwiązanie, drudzy, że lepsze jest drugie. Ministerstwo Finansów wybierze prawdopodobnie jedno z nich. Skutek będzie taki, że małe i średnie sklepy w stowarzyszeniach franczyzowych nie będą objęte podatkiem" – podsumował.
Minister Finansów Paweł Szałamacha powiedział PAP, że kwestia franczyzy i zrzeszania się przedsiębiorców będzie wymagała dyskusji – odpowiedniego skonstruowania definicji sieci handlowej i definicji podatnika.

Jest wstępne porozumienie rządu z handlowcami. Nie będzie wspólnego opodatkowania sklepów działających pod jedną marką franczyzową. Ale trzeba poczekać na ministerialną definicję franczyzy.

Interwencje przedsiębiorców i organizacji branżowych przyniosły skutek. Rząd podjął decyzję o wycofaniu się z koncepcji wspólnego opodatkowania sklepów działających pod jedną marką franczyzową. Opodatkowane zostaną natomiast sieci sklepów należące do jednego właściciela. Wciąż trwa dyskusja o opodatkowaniu specjalnym handlu w weekendy i opodatkowaniu handlu paliwami. Nie wiadomo, czy rząd ustąpi w sprawie opodatkowania handlu w internecie. Ale na pewno zrezygnuje ze stawki progresywnej podatku na rzecz jednej, płaskiej – w tej sprawie interweniowała Komisja Europejska.
O swoich nadziejach na zmianę projektu mówili przedstawiciele Polskiej Izby Handlu, którzy spotkali się z ministrem finansów, Pawłem Szałamachą. Według ich relacji minister wysłuchał ich opinii z uwagą i zapowiedział rewizję projektu. Od kilku dni szef resortu był krytykowany za projekt podatku. Wątpliwości w tej sprawie zgłaszali nawet inni członkowie rządu i posłowie PiS.
– Mając na uwadze, że zaobserwowane procesy konsolidacyjne w polskim handlu mają korzystny wpływ na sytuację małych niezależnych placówek handlowych, należy rozważyć, czy nałożenie podatku w zaproponowanej formie nie spowoduje zatrzymania tego trendu. Istnieje obawa, że przedsiębiorcy, którzy są niezależnymi podmiotami, będą rezygnować z działania pod wspólną marką wyłącznie po to, aby uniknąć płacenia podatku. Istnieje ryzyko, że proces ten (ewentualna zmniejszona opłacalność tego typu współpracy) będzie mógł mieć niekorzystny wpływ na konkurencyjność na rynku oraz na kondycję polskich przedsiębiorców współpracujących dotychczas pod wspólną marką. Problem ten powinien znaleźć odzwierciedlenie w analizach wykonywanych w ramach oceny skutków regulacji – napisał w swojej opinii Mateusz Morawiecki, minister rozwoju.
Po środowym (10.01) spotkaniu konsultacyjnym między rządem a handlowcami szef Parlamentarnego Zespołu na rzecz Wspierania Przedsiębiorczości i Patriotyzmu Ekonomicznego Adam Abramowicz (PiS) stwierdził, że podczas dyskusji ustalono, że w projekcie zmienione zostaną również przepisy dot. franczyzy. "Definicją franczyzy będzie w ustawie znak towarowy w powiązaniu z przepływami kapitałowymi albo przepływem towarów. Była na ten temat dyskusja na sali. Niektórzy mówili, że lepsze jest pierwsze rozwiązanie, drudzy, że lepsze jest drugie. Ministerstwo Finansów wybierze prawdopodobnie jedno z nich. Skutek będzie taki, że małe i średnie sklepy w stowarzyszeniach franczyzowych nie będą objęte podatkiem" – podsumował.
Minister Finansów Paweł Szałamacha powiedział PAP, że kwestia franczyzy i zrzeszania się przedsiębiorców będzie wymagała dyskusji – odpowiedniego skonstruowania definicji sieci handlowej i definicji podatnika.
A więc piłka wciąż jest w grze.
